Terms

These Terms govern your use of Casa Selvedge Creative Agency Ltd's website and services. By using the site or signing a Studio, Brand or Empire engagement, you agree to these Terms.

1. Services

We deliver AI-generated creative assets ... stills, motion, ad creative, and (on Empire) bespoke brand-trained models ... under the tier you select. Volumes, turnarounds and deliverables are stated on the pricing page and reaffirmed in your contract.

2. Fees & cancellation

• Fees are billed monthly in advance via Stripe in GBP, exclusive of VAT.
• You may cancel at any time. Cancellation takes effect at the end of the current billing month.
• Founder pricing locks in for as long as the engagement remains continuous.
• Late payment of more than 14 days suspends service until cleared.

3. Intellectual property

• You own every finished asset we deliver to you, with full commercial rights in perpetuity.
• On the Empire tier, you also own the trained brand model and may take it with you on exit.
• You retain all rights in the materials you supply us. You grant us a licence to use them solely to deliver the services.
• We may showcase work in case studies only with your written consent (founder pricing customers consent in advance to non-confidential case studies).

4. Acceptable use

You will not ask us to generate assets that depict identifiable individuals without their consent, minors in any commercial context, or content that violates UK law (including the Online Safety Act 2023, the Equality Act 2010, advertising codes (CAP / BCAP) or the Consumer Protection from Unfair Trading Regulations). We reserve the right to refuse work that we believe violates these constraints.

5. Warranties & liability

We warrant we will deliver the services with reasonable care and skill. We do not warrant that AI-generated output will be free of resemblance to existing creative works; you remain responsible for legal review of how you deploy assets we deliver. Our aggregate liability under these Terms is capped at the fees paid in the 12 months preceding the claim, except for liability that cannot be excluded under English law.

6. Term & termination

Either party may terminate for material breach not cured within 14 days of notice. We may terminate immediately for non-payment, prohibited use, or insolvency. On termination we will deliver any work in progress paid for to date.

7. Confidentiality

Each party will keep the other's confidential information confidential and use it only to perform under these Terms. This survives termination for two years.

8. Data

Our handling of personal data is governed by our Privacy Notice, which is incorporated into these Terms.

9. Governing law

These Terms are governed by English law. The courts of England and Wales have exclusive jurisdiction over any dispute arising from or in connection with them.
